Nota de Repúdio contra recolhimento de carteiras funcionais e armas de peritos em Rondônia

A Associação Brasileira de Criminalística - ABC, entidade que representa os Peritos Oficiais de Natureza Criminal dos Estados e do Distrito Federal, vem, por meio desta, repudiar o ato do Delegado-Geral da Polícia Civil do Estado de Rondônia, Samir Fouad Abboud, que determinou, no dia 7 de abril, o recolhimento das carteiras funcionais, armas, munições, algemas, coletes balísticos e quaisquer outros materiais que estejam acautelados aos policiais que estão cedidos para a Superintendência de Polícia Técnico-Científica – POLITEC.

Trata-se de medida abusiva e injustificada tomada contra os servidores da Perícia Oficial do Estado de Rondônia, conforme se observa a seguir:

1. Os servidores da perícia de Rondônia continuam sendo Policiais Civis, estando somente cedidos para a POLITEC, conforme previsto na Lei Complementar  nº 847/2015.

2. A Lei Complementar nº 828/2015, que criou a POLITEC, prevê, em seu Artigo 1º, que todo o patrimônio pertencente ao antigo Departamento de Polícia Técnica – DPT da Polícia Civil passou a pertencer à POLITEC, não fazendo nenhuma exceção com relação a quaisquer materiais, incluindo armas, munições, algemas e coletes balísticos.

3. Sendo os servidores da POLITEC Policiais Civis, eles deverão cumprir o previsto no Estatuto da Polícia Civil (LC nº 76/1993) que apresenta dentre os deveres funcionais o de sempre portar a carteira de identificação funcional, e seu descumprimento é passível de punição.

4. Na mesma linha, de acordo com o previsto no Artigo 301 do Código de Processo Penal, todo policial tem o dever de prender quem quer que seja encontrado em flagrante delito, sendo necessário o fornecimento, por parte do Estado, dos meios necessários para tal, no caso arma de fogo e algemas, além de colete balístico para a proteção pessoal do servidor.

5. A afirmação de que existem decisões do Supremo Tribunal Federal – STF de que Peritos e Auxiliares não podem atuar como policiais e, por isso, perderam o porte de arma, é inverídica. A única decisão a este respeito foi prolatada na ADI 5010, que trata de um caso diverso do apresentado, pois em RO os Peritos e Auxiliares continuam sendo Policiais Civis.

Assim sendo, esta Associação manifesta-se publicamente contrária a tais medidas pois as consideram descabidas e abusivas. Solicitamos ainda, nos termos de ofícios que serão encaminhados, que o Governador do Estado, Marcos José Rocha dos Santos, e o Secretário de Estado da Segurança, Defesa e Cidadania, José Hélio Cysneiros Pachá, resolvam o imbróglio passando a tutela de tais materiais para a POLITEC, além de permitir que o Diretor-Geral de Polícia Técnica emita carteiras de identificação funcional, mantendo os direitos e prerrogativas dos servidores que continuam sendo Policiais Civis.
